Terms and Conditions.
AVALON COMMUNAL SERVICES
By using any of the services provided by AVALON COMMUNAL at an AVALON COMMUNAL site (Site), you agree to be bound by these terms and conditions.
These terms and conditions and any premises and services offered at each Site are subject to change from time to time at AVALON COMMUNAL’s sole discretion. Changes will be effective immediately, unless stated otherwise.
Fees
Fees for the rental of premises or space (Premises) are payable in advance of the use of the premises.
Service fees will be determined at AVALON COMMUNAL’s sole discretion. You will receive at least 30 days’ notice of changes in fees.
Services
A reference to ‘services’ in these terms and conditions relates to any service, other than the rent of Premises, provided by AVALON COMMUNAL to you and your visitors.
Business grade WIFI internet connection is available for unlimited access on a fair use basis. AVALON COMMUNAL reserves the right to refuse connection in circumstances of excessive or illegal use.
Insurance
You agree that you are solely responsible for the security of your property at a Site and that it is your responsibility to insure any property that you bring to a Site and your liability to any employees and third parties.
AVALON COMMUNAL strongly recommends that members obtain appropriate insurance to cover:
their personal property (including, but not limited to, furnishings and technology); and
any liability that they may owe to their own employees, visitors or any other persons; and
any other risk that a prudent tenant would insure against.
AVALON COMMUNAL does not accept any liability, and its insurance does not cover, any loss incurred by you or any visitor.
Liability
To the maximum extent permitted by law, AVALON COMMUNAL, its related bodies corporate and their officers, employees, contractors and agents shall not be liable for any:
theft, loss or damage from any Premises or Site, howsoever occurring, or for any damage done to a member’s belongings or other effects at a Site by a caretaker, cleaner or any employee, contractor, agent or invitee of AVALON COMMUNAL; or
loss, damage or loss of information resulting from any communications or data failure including voice, communication and the internet; or
loss, damage, corruption of data or any loss of information whether from hardware, software or internet damage that may occur to a member.
Visitors
All visitors entering the Site must comply with any safety, emergency and COVID-safe procedures.
Visitors are not permitted at a Site outside regular hours (being Monday to Friday 7:30am – 5:30pm) without AVALON COMMUNALS’s prior consent.
Use and care of Premises and Sites
You must:
take care of the Premises and to keep them in a clean, tidy and presentable condition;
not commit any nuisance, annoyance or harassment to anyone at a Site;
not interfere with or disrupt the use and enjoyment of a Site by other members and visitors;
not sleep overnight at a Site;
not smoke or vape at a Site;
not use the Premises or the Site for any immoral or illegal purposes or in any way that breaches these terms and conditions, any applicable local, state, federal or international law or regulation, and ensure that your employees, contractors, agents and invitees comply with the provisions of this clause 1.10.
MEETING ROOMS & EVENT SPACES
These terms and condition apply to all bookings made by or on behalf of AVALON COMMUNAL for any meeting or event space at any Site, unless stated otherwise.
Bookings
For all bookings, the full amount payable will be charged to the nominated card at the time of booking online.
Cancellations & refunds
All meeting room booking cancellations and reductions must be notified to AVALON COMMUNAL in writing.
Meeting room or desk hire bookings that are cancelled or reduced by notice in writing at least 24 hours before the start time will not be charged a cancellation or reduction fee, and will be refunded or credited at AVALON COMMUNAL’s sole discretion.
Meeting room or desk hire bookings that are cancelled or reduced by notice in writing less than 24 hours before the start time will be liable for 100% of the cost of the original booking, and will not be refunded or credited.
If, for any reason, the meeting room or desk hire that’s been booked is no longer available at the time requested, notice will be given as soon as possible and, subject to availability, a room of similar or higher standard offered at the same rate.
Use of facilities
Any damage caused to the fixtures, fittings and equipment in any meeting room or desk hire by you or any of your attendees, will be the responsibility to fix of the person the space is booked under.
You agree not to conduct any illegal activities within any meeting room or desk hire space.
Where a bar fridge is made available to you, any product opened will be charged accordingly. You are responsible for monitoring responsible use by your attendees.
After hours/weekend bookings
Any meeting room or event space booking outside standard business hours (being Monday to Friday 7:30am – 6pm) may incur an additional charge.
